According to the verdict of the city court No. 2, the incident occurred in August in Pavlodar. A man, having consumed alcohol, went to a store.
On his way, he noticed a woman in the dark who, as he perceived, was giving him the middle finger. This outraged the Pavlodar resident, and he decided to clarify the situation.
"In front of the store, the defendant caught up with her and asked, 'Why are you showing me obscene gestures with your hands (the middle finger)?' To which she did not understand what he wanted from her and started to step back," the court's verdict states.
The court established that, not receiving a response, the defendant began to beat the victim.
"The defendant struck one blow with his left fist to the area of her right eye. From the blow, the victim lost her balance and fell to the ground, began to scream, calling for help. When she tried to get up, the defendant, leaning over her, struck her in the head with his right fist, causing her to bleed from the nose. He also delivered one kick to her body, which made her twist in pain and lie on the ground, motionless," the court's verdict indicates.
According to the court, taking advantage of the situation, the man additionally pulled money and a smartphone from the victim's pocket. He then said that she could retrieve her phone but would have to bring more money, after which he fled the scene.
The criminal case was examined in court under paragraph 1 of part 2 of article 191 of the Criminal Code of the Republic of Kazakhstan (Robbery). The Pavlodar resident fully admitted his guilt. He had previously been convicted of intentionally causing serious harm to health and was still serving a sentence of restricted freedom.
Based on the cumulative sentences and the evidence collected in the case, he was sentenced to 3 years and 7 months of imprisonment. The court's verdict has not yet come into force.
Furthermore, according to paragraph 1 of part 2 of article 191 of the Criminal Code of the Republic of Kazakhstan, robbery, which is the open theft of someone else's property committed with the use of violence that is not dangerous to the life or health of the victim, or with the threat of such violence, is punishable by restriction of freedom for a period of three to seven years or imprisonment for the same period, along with the confiscation of property.
Previously, in Shymkent, a verdict was issued against a defendant accused of attempting to rob a pawnshop with a toy gun. An 18-year-old visitor thwarted the robbery.
