A hospital-bound employee of the akimat has been dismissed in the Zhambyl region.

According to the official court account on Facebook, the Zhambyl Regional Court reviewed a civil case filed by a citizen against the construction department of the akimat, seeking to declare the dismissal order unlawful, recover wages for the period of forced absence, and receive compensation for moral damages.

On January 15, 2024, the woman sought medical attention at the city clinic due to health issues, where she was diagnosed and prescribed inpatient treatment from January 16 to January 23, 2024, for which she was issued a medical certificate. She returned to work on January 24, 2024.

"By the employer's order dated January 30, 2024, the plaintiff was dismissed due to her absence from work on January 15, 2024" , the court noted.

The Taraz City Court denied the claim. However, the appellate panel, upon reviewing the case, granted the claim on the following grounds.

"The plaintiff provided evidence of a valid reason for her absence from work" , the court established.

The judicial panel declared the dismissal order during the employee's illness as unlawful and invalid.

The construction department was ordered to pay wages for the forced absence amounting to 403,000 tenge, compensation for moral damages of 200,000 tenge, and legal expenses of 300,000 tenge.

The court ruling has already entered into legal force.

Previously, in the Mangistau region, a teacher's diploma was deemed forged due to an error, resulting in her dismissal after 12 years of service at the school. The educator proved her case and received over 2.8 million tenge from the education department.

In the Zhambyl region, a woman's rights to maternity leave until her child turns three were upheld, and her dismissal during a reduction was declared unlawful. The employee approached the deputy akim of the region requesting maternity leave but was dissatisfied with the response and filed a lawsuit.
