According to the official court account on Facebook, a case involving a local resident charged with petty hooliganism (part 1 of article 434 of the Administrative Code) and violating legislation on the organization and conduct of peaceful assemblies (part 7 of article 488 of the Administrative Code) was reviewed in the specialized administrative offenses court of Semey.
"The channel '102' received a report about an unknown woman who, while in a state of intoxication, was disturbing public order and using foul language in the presence of police officers and bystanders," - the court reported.
Officers from the patrol police battalion of the Semey Police Department took the woman to the Temporary Adaptation and Detoxification Center, where her identity was established, and a medical examination was conducted.
According to the medical examination report, she was found to be in a state of moderate intoxication.
"Earlier that same day, the woman sent an audio message via the WhatsApp messenger to a group of 183 participants calling for participation in a rally on December 16, 2024, but she did not have permission from the local executive authority," - the court established.
The local resident admitted her guilt in committing the administrative offense and expressed remorse for her actions.
In determining the administrative penalty, the court considered that the woman has a dependent child under the age of 14, and therefore, in accordance with part 2 of article 50 of the Administrative Code, administrative arrest was not applied to her.
The court ruled to impose an administrative fine of 20 MRP (73,840 tenge) and 50 MRP (184,600 tenge), respectively.
The ruling has not yet entered into legal force.
It should be noted that under part 1 of article 434 of the Administrative Code of the Republic of Kazakhstan, using foul language in public places, offensive behavior towards individuals, and other similar actions that express disrespect towards others and disturb public order and the peace of individuals, entail a fine of 20 MRP (73,840 tenge) or administrative arrest for a period of 5 to 15 days.
In accordance with part 7 of article 488 of the Administrative Code of the Republic of Kazakhstan, organizing and/or conducting meetings, rallies, demonstrations, processions, pickets, or other public events in violation of the procedure established by the legislation of the Republic of Kazakhstan on the organization and conduct of peaceful assemblies, if these actions do not have the characteristics of a criminal offense, result in a fine for individuals of 50 MRP (184,600 tenge) or administrative arrest for up to 15 days, and for legal entities, a fine of 100 MRP (369,200 tenge).
